WE-AR Inc., a Korean company, with registered and business offices at 04479, 4F, 19, Seongsuil-ro, Seongdong-gu, Seoul (“WE-AR Inc.”), respects your privacy and provides you with this Privacy Policy (“Privacy Policy”) so that you may understand the ways in which we do and do not use the information you transmit when accessing and playing WE-AR Inc.'s apps and games, accessing and using websites, platforms, software services, and related services (hereinafter the “Apps”, “Games”, “Services”). Please note that your access and/or playing of the Apps and Games constitutes your acceptance of this Privacy Policy as well as our Terms of Use.

WE-AR, Inc. (“Apps”, “we”, “us”, and/or “our”) operates the applications (the “Apps”) and other related services (collectively, the “Services” and "Games").

We are committed to protecting your privacy. This Privacy Policy describes how we collect, store, use, and share information through our Services.

We are dedicated to safeguarding the privacy and confidentiality of your information. When you utilize Our Service (including the Apps and Games), you may share information during your interaction with Our Service. We may also utilize data about your website visits to promote Our Service, but we will never exploit or reveal the content of your service data for marketing or advertising purposes.

“Personal Data” shall mean any information relating to a Data subject; an identifiable person is one who can be defined, directly or indirectly, notably by reference to an identifier such as a name, an identification number, location data, an online identifier, or to one or more factors specific to his/her physical, physiological, genetic, mental, economic, cultural, or social identity of that natural person. Contact data and Service Data are Personal Data.

“Contact Data” means any names, phone numbers, e-mail addresses, and certain financial details held within commercial systems to conduct the Parties’ relationship management and billing transactions between the Parties;

“Service Data” means any Party’s Personal Data (that is not Contact Data) held within the Parties’ systems, applications, or databases and that may be accessed, processed, used, or stored as a consequence of performing the services under the Agreement.

2. Information you provide

Through your use of the Services provided by WE-AR, you may provide us with the following information:

Account information. This includes your name, email address, and password. If you choose to log in using another service, such as Apple, we receive information about the service you used to log in and — depending on your chosen account settings with Apple — details about you, including your name, email address, or unique user identifiers.

Payments, transactions, and rewards. When you make purchases through the Services, our third-party payment processor, Stripe, collects your payment information. We maintain a record of your purchases, the features you select, and the rewards you earn and use.

2.1. Information we collect automatically

We automatically log the following information about you, your computer or device, your network, and your interactions over time with our Services and our communications:

• Device and network data. This includes your computer’s or mobile device’s operating system, manufacturer and model, browser, IP address, device and cookie identifiers, language settings, mobile device carrier, and general location information such as city, state, or geographic area.

• Usage data. This includes information about how you use the Services, such as your interactions with the Services, the links and buttons you click, and page visits.

We use cookies, web beacons (e.g., pixel tags), and local storage technologies (e.g., HTML5) to collect some of this information.

Our advertising partners may also use such technologies to collect limited information about your device and interactions with the Services, such as the links you click, pages you visit, IP address, advertising ID, and browser type, but they will never have access to your conversations with you.

2.2. Information collected through the Game

Where applicable, access and playing of certain basic Game versions, experience of certain basic content and games features may not require registering of an account with applicable platform/service providers that are providing the Game etc. to you. However, in order to access and play the complete Game, access certain premium game functions, levels, content and features you must register an account with the platform/service providers that are providing the Game etc. to you. You must then create an account with the platform/service providers’ platforms that hosts the Game to access such premium game functions, levels, content and features etc. To create an account you are required to provide certain mandatory information such as your name, your email address, account login etc. which is mandatory in order to be able to establish an account. WE-AR Inc. and/or the platform/service providers (i.e. Apple App Store, Google Play, etc.) collects financial information on the terms and conditions set out in this Privacy Policy and/or the platform/service providers’ own Privacy Policies, which can be found on the respective platforms. WE-AR Inc. does not use financial information for any purpose other than processing payments. Further you may, but may not be required to, provide certain voluntary information such as date of birth, screen name, your personal profile in the Game, interests in and use of various games, products and services, and any other personal or preference information.

3. Use of your information

3.1. We use your information for the following purposes:

• Personalizing your experience with our Services.

• Providing and improving our Services.

• Communicating with you, including responding to your inquiries and providing customer support.

• Analyzing usage trends and preferences to enhance our Services.

• Protecting the security and integrity of our Services.

3.2. Sensitive information.

However, we may share information about you with certain third parties based on the legal basis as follows:

• Third Party Agents and Contractors: We may share information about you with third party agents and contractors to provide Our Service (the "Game" and "Apps") to you, for ongoing development, for analytical purposes, etc. Information will be provided to such third party agents and contractors only for their specific assignments for us, consistent with this Privacy Policy, and for no other purposes, ensuring an adequate level of protection of the Personal Data in accordance with agreements with us.

• Social Networks: Where Our Service and related services are accessed and/or provided through social networks.

• Third Parties: When required by applicable law, rule, regulation, legal process, in the process of negotiations of any mergers and acquisitions, sale of company assets, financing, or acquisition of all or a portion of our business by another company where personally identifiable information submitted to us may be transferred to the acquiring entity.

• Courts, Law Enforcement Agencies, Legal Authorities, etc.: When ordered or requested by courts, legal authorities, etc., and required for us to abide by applicable laws or to protect our rights, in defense in lawsuits, property, or safety of WE-AR Inc., Our Service, end users, etc.

• Other End Users: In order to provide certain Our Service features.

• Advertising Networks: For advertising purposes, we may share your advertising ID with advertising partners to serve behavioral advertisements to you within Our Service if you have given consent.

Please note that in some instances, certain third parties’ use of Personal Data will not be covered by this Privacy Policy. In such cases, you must review such third parties’ privacy policies.

4. Handler of your information

4.1. Service providers:

We engage companies and individuals to perform services on our behalf or assist us in operating Our Service or our business, such as hosting, information technology, customer support, email delivery, and website analytics services. Additionally, we may utilize marketing service providers to assist in promoting Our Service, but we do not disclose the content of your interactions within the Apps and Games for marketing or advertising purposes. For example, we may share your email address with marketing service providers to send marketing emails on our behalf and to identify potential users interested in Our Service. We require these service providers to only use your information as instructed and not for any other purpose.

4.2. Professional advisors:

WE-AR Inc. has taken reasonable steps to ensure that the personally identifiable information it collects is secure, and we have implemented measures to protect the confidentiality, security, and integrity of the Personal Data collected from users of Our Service (the "Apps" and "Games"). Personal Data is stored in secure operating environments that are not available to the public and are accessible only to authorized employees and contractors. We have security measures in place to protect against the loss, misuse, and alteration of the information under our control. However, perfect security does not exist. Therefore, while we strive to protect personally identifying information, we cannot guarantee the security of any information transmitted to us through or in connection with Our Service, stored on our systems, or stored on our service providers' systems.

Please note that WE-AR Inc. may provide links to other apps and websites that are operated and hosted by third parties who may have their own information collection practices. Those other apps and websites are governed by their own privacy policies, which may differ substantially from WE-AR Inc.’s policies. Visitors to other apps and websites are encouraged to review the privacy policies and information collection practices of those websites.

We implement various industry-standard security technologies and procedures to safeguard your data from unauthorized access, use, or disclosure. All transmitted data are encrypted during transmission using standard Secure Socket Layer (SSL) encryption. Stored data are maintained on secure servers, and access is protected by multi-layered security controls, including firewalls, role-based access controls, and passwords.

Your account is protected by a password, and it is essential to prevent unauthorized access by selecting and safeguarding your password appropriately. Additionally, you should limit access to your computer or device and sign out after completing your account access.

While we employ reasonable commercial efforts to protect your data, no technology, data transmission, or system can guarantee 100% security. In the event of a security breach leading to accidental or unlawful destruction, loss, alteration, unauthorized disclosure, or access to your data, we will promptly notify you.

Any improper collection or misuse of User Created Content or information provided in Our Service is a violation of the Terms of Use and should be reported to WE-AR Inc. at products@we-ar.kr

6. Where we store your information

Our Services are operated from the Republic of Korea. If you are located in another jurisdiction, please be aware that the information you provide to us may be transferred to, stored, and processed in the Republic of Korea, a jurisdiction in which the privacy laws may not be as comprehensive as those in the country where you reside or are a citizen.

6.1. International Data Transfers

We may transfer and share your information to third parties (including service providers operating on our behalf) which may be located in countries outside the Republic of Korea (“Korea”) which may not have the same level of data protection laws as those in the country where you are located.

8. Payment Information

To access the complete Our Service ("Apps" and "Games"), certain premium game functions, levels, content, and features, etc., you are required to pay certain fees. When purchasing such features and functions, you may be asked by the platform/service providers to provide certain personally identifiable information, such as full name, billing address, email address, phone number, and credit card number/expiration date, etc. Please note that you must be the age of 18 or older to make purchases in Our Service. However, children over thirteen but under eighteen may access and play the game under the supervision of a legal guardian.

Once End Users have successfully entered valid credit card information, etc., and completed the order process, a purchasing account will be created and maintained for them. The platform/service providers will use the information provided to process the End User’s order and to send order confirmations via email, as well as to make future purchases easier for the End User. WE-AR Inc. does not sell, transfer, or share customer information with third parties, except where applicable, the information is transferred, disclosed, and shared with its third-party agent(s) who use the information solely to handle and deliver certain online activities necessary to operate WE-AR Inc.'s business (e.g., processing orders and payments).

9.1. Opt-out of marketing communications

You may opt out of marketing-related emails and other communications by following the opt-out or unsubscribe instructions in the communications you receive from us or by contacting us as provided in the “Contact us” section below. You may continue to receive Services-related and other non-marketing emails from us.

We share information with third-party advertising partners and allow them to collect information about your visit to our Website using cookies and other tracking technologies to display targeted advertising around the web as described in the “How we share your information” section above. In some instances, your choices may be limited, such as where fulfilling your request would impair the rights of others, our ability to provide a service you have requested, or our ability to comply with our legal obligations and enforce our legal rights. If you are not satisfied with how we address your request, you may submit a complaint by contacting us as provided in the “Contact us” section below. Depending on where you reside, such as if you reside in the European Economic Area or United Kingdom, you may have the right to complain to a data protection regulator where you live or work, or where you feel a violation has occurred.

9.5. Right to erasure (‘right to be forgotten’)

You can request the deletion of your personal data. We are guided by the principle of integrity and confidentiality measures, so to delete data please contact us via email: products@we-ar.kr . Please note that personal data that you have provided to us based on your consent will be deleted.

Our Service is not intended for individuals under the age of 18. If we discover that minors under the age of 18 are using the Apps, we will promptly block their access and delete their account.
